Lawyers have been the butt of many jokes over the years. Being charged with a crime is No Joke and having a good lawyer can make a huge difference. Just as there are many different types of doctors, so too are there many types of lawyers. When you have medical issues with your heart, you go to a cardiologist, not a pediatrician. When a person is truly innocent, only a dismissal of the charges will suffice. This can be accomplished by either persuading the State's Attorney or the jury. A lawyer with a good reputation can more easily persuade the State's Attorney to dismiss the charges rather than take a chance with the jury. The jury system is not infallible. The Constitution only requires guilt beyond a "reasonable" doubt – it does not require guilt beyond "all" doubt. People often are frustrated that some guilty go free because the evidence did not eclipse the standard of beyond a reasonable doubt. But more tragic is that place between "reasonable doubt" and "all doubt" contains the innocents that have been wrongly convicted. Don't take chances with a discount or inexperienced lawyer. Too much is at stake.
We are not perfect beings and all make mistakes in judgment on occasion. However, simply throwing yourself on the mercy of the court may not be wise. Second, third and even more chances are given in the criminal system. What you need is an advocate – in other words – a good criminal lawyer. Seeking leniency from the prosecutor or judge by pointing out lack of prior record or good citizenship can make a tremendous difference. An even more important factor in obtaining a good deal is the strength of the prosecutor's case. No prosecutor wants to go to trial and lose the case. A skilled criminal defense lawyer can point out the weaknesses of the prosecutor's case and back it up by taking the case to trial and convincing a jury to return a verdict of not guilty. Thus, the better criminal lawyer can get a better deal because the better criminal lawyer weakens the prosecutor's case.
The Constitution states that all persons are presumed innocent unless proven guilty beyond a reasonable doubt. This presumption is pitted against police officers and prosecutors gunning for a conviction. When officers write their reports, they routinely only include information leading to a guilty conclusion. When prosecutors present their case to the jury they present evidence of guily, not innocence. Without a good lawyer, the facts leading to inncocence often do not get presented.
